Key changes flowing from the GDPR :

A number of important new data protection obligations and rights affecting those processing personal data will soon be in force and they include:

● Expanded scope - the new rules will apply to all organisations processing personal data in relation to EU citizens, even if they are not based in the EU;

● Enhanced consent requirements - consent will only be validly obtained if strict requirements are met;

● Greater accountability - organisations will be required to prove that they are complying with the new data protection rules through improved procedures and documentation;

● New rights for individuals - these include the right to be forgotten, the right to data portability and the right to object to profiling for direct marketing purposes;

● Processors - for the first time, data processors will have direct obligations under data protection law;

● Notification of data breaches - mandatory notification to supervisory authorities and affected individuals in specified situations;

● Significant new fines - these can potentially be up to 4% of annual worldwide turnover or €20 million, whichever is greater.
