(140) The Board should be assisted by a secretariat provided by the European Data Protection Supervisor. The staff of the European Data Protection Supervisor involved in carrying out the tasks conferred on the Board by this Regulation should perform its tasks exclusively under the instructions of, and report to, the Chair of the Board.

Article 75 states that the Board secretariat shall be provided by the European Data Protection Supervisor and defines their tasks. In general, the secretariat shall provide analytical, administrative and logistical support to the Board.

In order to ensure the independence of the secretariat, Article 75 provides various safeguards, including organizational such as all the tasks of the secretariat shall be carried out under the exclusive authority of the Chair of the European Data Protection Board (paragraph 2). In addition, paragraph 3 imposes the organizational separation of the staff of the Board secretariat from that of the secretariat of the European Data Protection Supervisor, which implies that the Board secretariat must be subject to separate hierarchical relations, still intended to ensure its independence.

Paragraph 4 enables the Board, in conjunction with the European Supervisor, to establish and publish a Memorandum of Understanding applicable to the staff, implementing the aforementioned organizational separation and specifying the terms of cooperation between the Board and the European Supervisor.

Paragraph 6 contains a list of the tasks entrusted to the secretariat, namely: the day-to-day business of the European Data Protection Board; the communication between the members of the Board, its Chair and the Commission and the communication with other institutions and the public.

The secretariat must also ensure the use of electronic means for internal and external communication as well as the translation of relevant information.

 Finally, the secretariat shall ensure the preparation and follow-up of the meetings of the European Data Protection Board and also the preparation, drafting and publication of opinions, decisions on the settlement of disputes between supervisory authorities and other texts adopted by the Board.

Article 29 of the Directive stipulated that the Article 29 Working Party shall be assisted by a secretariat provided by the Commission.

Utfordringer

Given the magnitude of the tasks assigned to the European Board and its composition, we can only hope that the secretariat will receive all the necessary support and means to properly operate based on the requirements of the provision.

Art. 75

1. The Board shall have a secretariat, which shall be provided by the European Data Protection Supervisor.

2. The secretariat shall perform its tasks exclusively under the instructions of the Chair of the Board.

3. The staff of the European Data Protection Supervisor involved in carrying out the tasks conferred on the Board by this Regulation shall be subject to separate reporting lines from the staff involved in carrying out tasks conferred on the European Data Protection Supervisor.

4. Where appropriate, the Board and the European Data Protection Supervisor shall establish and publish a Memorandum of Understanding implementing this Article, determining the terms of their cooperation, and applicable to the staff of the European Data Protection Supervisor involved in carrying out the tasks conferred on the Board by this Regulation.

5. The secretariat shall provide analytical, administrative and logistical support to the Board.

6. The secretariat shall be responsible in particular for:

(a) the day-to-day business of the Board;

(b) communication between the members of the Board, its Chair and the Commission;

(c) communication with other institutions and the public;

(d) the use of electronic means for the internal and external communication;

(e) the translation of relevant information;

(f) the preparation and follow-up of the meetings of the Board;

(g) the preparation, drafting and publication of opinions, decisions on the settlement of disputes between supervisory authorities and other texts adopted by the Board.

1. The European Data Protection Board shall have a secretariat. The European Data Protection Supervisor shall provide that secretariat.

2. The secretariat shall provide analytical, administrative and logistical support to the European Data Protection Board under the direction of the chair.

3. The secretariat shall be responsible in particular for:

(a)     the day-to-day business of the European Data Protection Board;

(b)     the communication between the members of the European Data Protection Board, its chair and the Commission and for communication with other institutions and the public;

(c)     the use of electronic means for the internal and external communication;

(d)     the translation of relevant information;

(e)     the preparation and follow-up of the meetings of the European Data Protection Board;

The staff of the secretariat of the European Data Protection Supervisor involved in carrying out the tasks conferred on the European Data Protection Board by this Regulation shall be organizationally separated from, and subject to separate reporting lines from the staff involved in carrying out tasks conferred on the European Data Protection Supervisor.

1c. Where needed, the European Data Protection Board in consultation with the European Data Protection Supervisor shall establish and publish a Code of Conduct implementing this Article and applicable to the staff of the secretariat of the European Data Protection Supervisor involved in carrying out the tasks conferred on the European Data Protection Board by this Regulation.

2. The secretariat shall provide analytical, administrative and logistical support to the European Data Protection Board.

3. The secretariat shall be responsible in particular for:

(a) the day-to-day business of the European Data Protection Board;

(b) the communication between the members of the European Data Protection Board, its chair, and the Commission and for communication with other institutions and the public; 

(c) the use of electronic means for the internal and external communication;

(d) the translation of relevant information;

(e) the preparation and follow-up of the meetings of the European Data Protection Board;

(f) the preparation, drafting and publication of opinions, decisions on the settlement of disputes between supervisory authorities and other texts adopted by the European Data Protection Board.

Art. 75

Sekretariat

1. Personvernrådet skal ha et sekretariat, som skal stilles til rådighet av EUs datatilsyn.

2. Sekretariatet skal utføre sine oppgaver utelukkende under ledelse av Personvernrådets leder.

3. Personellet ved EUs datatilsyn som deltar i utførelsen av oppgavene som ved denne forordning gis Personvernrådet, skal ha andre rapporteringsveier enn personellet som deltar i utførelsen av oppgavene som EUs datatilsyn er gitt.

4. Dersom det er relevant, skal Personvernrådet og EUs datatilsyn utarbeide og offentliggjøre en programerklæring med henblikk på gjennomføring av denne artikkel med fastsettelse av vilkårene for deres samarbeid som får anvendelse på personellet hos EUs datatilsyn som deltar i utførelsen av oppgavene som ved denne forordning gis Personvernrådet.

5. Sekretariatet skal yte analytisk, administrativ og logistisk støtte til Personvernrådet.

6. Sekretariatet skal særlig ha ansvar for

a) Personvernrådets daglige virksomhet,

b) kommunikasjon mellom Personvernrådets medlemmer, dets leder og Kommisjonen,

c) kommunikasjon med andre institusjoner og med allmennheten,

d) bruken av elektroniske midler i forbindelse med intern og ekstern kommunikasjon,

e) oversettelse av relevant informasjon,

f) forberedelse og oppfølging av Personvernrådets møter,

g) forberedelse, utarbeiding av utkast til og offentliggjøring av uttalelser, beslutninger om løsning av tvister mellom tilsynsmyndigheter samt andre tekster som vedtas av Personvernrådet.
